| 摘 要： | 美洲人权机关对紧急状态下人权的保障,主要是围绕着<美洲人权公约>第27条所确立的标准而进行的实践.该条不仅规定了紧急状态的概念,还规定了基本权利不得克减、克减措施与紧急情势相称、禁止歧视、与其他国际义务相一致等原则和履行国际通知的义务,从而对国家宣布紧急状态的条件和在紧急状态下行使克减权作出了严格的限制.实践中,美洲人权机关根据上述标准,对紧急状态下的人权提供了积极的救济和保障.
