| 摘 要： | 在法治框架下建立紧急状态法制体系,是现代社会应对紧急状态的重要途径,紧急状态法制体系也因此成为宪政国家法制体系的重要组成部分,它主要包括四个层次的内容:宪法中关于紧急状态的条款;统一的紧急状态基本法;戒严法、公共卫生应急法等单行的紧急状态专门法;一般法律和国际条约中的紧急状态条款。

| Abstract: | The establishment of emergency law system within the framework of government by law is an important means of coping with emergency, which, therefore, forms an important part of the legal system in a constitutional country. It mainly consists of contents of four levels: (1) relevant provisions concerning emergency in the constitution; (2) unified basic law governing all emergency laws; (3) specific laws, such as martial law, law concerning public health etc.; (4) provisions relevant to emergency contained in ordinary law and international treaties or agreements. |
