| 摘 要： | 随着人类文明的发展、人权意识的增强和刑罚人道性的认同,世界各国刑罚结构趋轻化的改革已成为主流.而我国以死刑和自由刑为主导地位的重刑结构受到学界质疑,当代我国刑罚结构轻缓化改革已具有政策根据和哲学基础.减少死刑、缩减死刑比例、调整部分罪的法定刑、提高罚金刑地位和增设相关刑种应是我国刑罚结构改革的方向.

| Abstract: | With the development of human civilization,the growth of awareness of human rights and identification with humanitarian punishment,leniency of punishment has become widely accepted.However,our country's severe-punishment structure,which mainly consists of death penalty and punishment against liberty,has been criticized by scholars,and contemporary China's punishment mitigation reform has had its policy and philosophical foundation.The trend of our country's punishment mitigation reform is to reduce the number of death penalty,to limit the percentage of death penalty,to regulate some crimes' legally-prescribed punishment,to emphasize pecuniary penalty and to establish some new types of punishments. |
