2006年度中国法律方法论研究学术报告

在2006年,法学界对法律方法进行了更深入的研究。法律方法论已经成为法学研究的热点问题。已经觉醒的方法论意识,不仅引发了人们的理论兴趣,而且对司法实践也起着重要的推动作用。大量专著、论文的涌现,使我们看到法律方法理论更趋体系化,而具体的法律方法,如法律解释、法律推理、法律论证等的研究更加深入,类型(化)、拟制、类推、法律原则、法律渊源等方面的研究也取得一些新进展。此外,学界在部门法学以及法律史方面均对法律方法做了一定的探索。从总体上,我国法律方法论研究尚存在若干局限性,总结和改进这些不足有助于推进这方面的研究。

A Review of Research on Legal Methodology in China

The year 2006 witnessed great advances in the study of legal methodology,which became a hot issue of jurisprudential study.The awaking awareness for the study of legal methodology not only aroused people's theoretical interests,but also played an important role in judicial practices.Many relevant books and papers were published,and it seems that the theory of legal methodology is in shape.More progresses were made not only in the study of legal methods such as interpretation of law,legal reasoning,and legal argumentation,but also in the study of type,fiction,analogy,and principles and sources of law.In addition,legal method has also been explored in area of branch law and law history.On the whole,some defects still exist in the study of legal methodology in China,and reflecting on such defects will accelerate further study.
