| 摘 要： | 古希腊的法律修辞学刺激了辩证法的诞生,辩证法的论证工具——辩证推理同时也是逻辑学的一类研究对象。亚里士多德于分析性推理之外创立了论式理论系统,这种理论继而成为改造旧修辞学的利器。西塞罗在法律语境中将论式理论和修辞学紧密结合起来,形成了高于古代法律修辞学的新形式。辩证法、修辞学和逻辑,通过论式学说纠结在一起。现代论式学说的复兴,以承认分析性推理和论式性推理或辩证推理的区别为出发点。法律论证三学科——法律修辞学、法律辩证法和法律逻辑的互动发展,表明一种全面的法律论证理论有必要反映这三个学科的不同视角和规范,并汲取它们的精华。

| Abstract: | Legal rhetoric in ancient Greece facilitated the birth of dialectics while the argument tool of dialectics-dialectical reasoning-is one object of logic study.Apart from analytical reasoning,Aristotle introduced the theoretical system of topoi,which became an edge tool for transforming the old rhetoric.Cicero integrated topoi theory with rhetoric in the legal context and established a new model superior to ancient legal rhetoric.The dialectics,rhetoric and logic are kinked together by topoi.The modern topoi ... |
