| 摘 要： | 民俗习惯对中国的司法实践不仅具有理论上的价值,更有现实的作用,包括实用、补充、转化三种功能.从民事审判与刑事审判角度,对民俗习惯与国家法互动进行分析,可以印证民俗习惯对中国司法的理论价值与现实作用.因此,要充分重视民俗习惯在解决纠纷、和谐司法中的作用.

| Abstract: | Folk customs have not only theoretical value to in China's legal practices,but also practical functions,including practicality,supplementation,and transformation.The analysis of the interaction between folk customs and state laws from the angle of civil trial and the criminal trial,can support to the idea that folk customs have not only theoretical value but also practical applications in the administration of justice in China.there fore,judges should take full advantage of folk customs in settling dispute in order to guarantee harmony in the administration of justice. |
