| 摘 要： | 笔者在徽州调查的过程中,在桃林村发现了该村以村规民约的方式侵犯异姓儿童财产分配权利的案件。通过对案件的解读,发现该案充分展现了村规民约与法律规定之间的制度紧张。为了深入剖析该种制度紧张,文章对现有徽州村规民约和历史上的徽州乡规民约进行了深入的探讨。最终发现,桃林村的做法是在用村规民约的形式实施着传统法律的规定。因此,所谓的制度紧张,在深层次上是传统法律与现代法律之间的紧张,而且正是这种紧张塑造了现有村规民约的演进方式及其内容,并最终导致了桃林村违法村规民约的出台。

| Abstract: | When investigating local customs and regulations in Hui County,I came across a representative case in which a village community deprived a child of his legal collective property because he has a different family name.What is of great concern is that the village community availed itself of the local customs and regulations to achieve the purpose,thus the modus operandi created the tension between village by-laws and law.In order to understand and analyze the tension,I elaborate the present and the past village by-laws of Hui County.The study of the case points to the fact that village community could implement provisions of traditional laws in the name the village by-laws.Therefore,the tension is actually between traditional law and current law.Such tension,in turn,impacts the evolution of the village by-laws and the above-said illegal local regulations are but the products of the tension. |
