论清律对明律的继承和发展

《大清律例》作为中国古代最后一部封建法典,无论从制定过程、体例结构和内容等方面均继承了《大明律》,并有所发展;尤其是在继承明律的基础上,根据当时社会形势的发展变化随时进行损益,对维护清朝两百多年的封建统治起了重要作用。清律对明律成功的继承和发展,对今天继承传统法律、移植西方法律、完善社会主义法律、建设社会主义法治国家,无疑具有重要的现实借鉴意义。

Discussion on the heritage and development of the law of Qing Dynasty from the law of Ming Dynasty

As the last feudal code in ancient China,Da Qing Lu Li inherits and develops Da Ming Lu,including enacting courses,styles,structures and contents and so on.What's more Da Qing Lu Li,on the basis of heritage,increases and decreases regulations in the light of the development and change of the social situation at that time.This is very important to safeguard feudal sovereignty of Qing Dynasty for more than two hundred years.There is no doubt that the successful heritage and development of the law of Qing Dynasty to the law of Ming Dynasty have very practical significance for China to inherit traditional law,transplant western law,improve socialist law and construct socialist lawful country.
