公共行政人员行为选择的伦理剖析

为研究公共行政人员的职权行为，运用文献分析方法和规范的方法对行政人员的行为动因及其产生的困境进行分析。分析认为，作为一个社会存在物，“经济人”或“公共人”的人性假设无法解释公共行政人员的行为动因及其行为选择所产生的伦理困境。而“利益人”的人性假设正与行政人员多样化的行为选择相契合，并且有力地解释了行政人员在行为选择中所产生的对公共利益负责还是对组织负责、对岗位职责负责还是对社会职责负责、对个人正当权益负责还是对公共利益负责的伦理困境。分析结果表明，只有通过制度伦理建设与行政人员的个体伦理救治，才能化解行政人员行为选择所产生的伦理困境，实现负责任的行政行为。

Ethical analysis on action choice of public administrators

In order to disscuss authoritative actions of public administrators, this paper makes use of literature analysis and normative analysis to analyze the cause and the dilemma of the choice of administrators＇ action. The author thinks that as a social existence neither economic men nor public men can explain the cause and the ethical dilemma. Just interest man can thoroughly explain the puzzle. During the authoritative action, administrators are often troubled by such questions：should they be responsible for the public interest or party interest.9 Should they fulfill post duty or social duty.9 Should they stand on individual just interest or public interest.9 The results show that only by combining the institutional ethics with individual ethics can they get rid of the dilemma and achieve responsible authoritative actions.
