| 摘 要： | 民族优惠政策之所以被制定与实施,并不是简单地给予少数民族的社会救济与社会福利,而是本身就具有证成其正当性的法理依据,即马克思主义民族平等理论、民族区域自治理论、政治哲学中的公平正义理论和少数民族权利的特殊保护理论.正当性的证成有助于理性回应质疑和否定民族优惠政策的观点,但这并不等于民族优惠政策可以一成不变了.实践中,应不断完善、创新民族优惠政策,以适应时代的发展和社会的进步.

| Abstract: | The reason why preferential policy for ethnic minorities is being formulated and implemented is not simply for granting the social relief and social welfare for ethnic minorities. Indeed, there are jurisprudential bases to interpret validity and legitimacy of preferential policy for ethnic minorities, including Marxism theory of equality of ethnic groups, the theory of regional autonomy for ethnic minorities, justice theory of political philosophy and the theory of special guarantee of rights of ethnic minorities. These jurisprudential foundations are helpful to respond to the perspective that queries or negates prefer- ential policy for ethnic minorities. However, it does not indicate that preferential policy for ethnic minor- ities is and will be the best of all possible. The government must improve and innovate preferential policy for ethnic minorities with development of society, in the course of experience. |
