论中国海外投资理论建构与相关法律对策

中国海外投资理论的建构不能脱离中国经济发展的"二元经济"结构与"华人经济"的文化传统等特点,既不能照搬西方发达国家学者提出的微观竞争优势理论,也不能适用邓宁提出的宏观国际生产阶段理论,而必须正视中国经济发展的具体实际,揭示中国海外投资理论建构的前提,建构一套适合投资动机多样化和投资理论多元化的海外投资理论体系,用以分别解释和指导不同投资主体的海外投资活动,并为中国海外投资立法提供理论阐释和法制要求。

Building China's Overseas Investment Theory and Relevant Legal Game

The theory of China's oversea investment should be set up. It can not be separated from the reality of China's "dual economy" structure and the culture tradition of "Chinese economy". It can not copy the developed countries' theory of micro-competitive edge, nor adopt J.H.Dunning's theory of international production stages. China's overseas investment system should be established on the premises that the specific reality of china's overseas investment theory should be revealed. The system should be suitable to maneuverable diversification and pluralization of overseas investment, so that it could respectively be used to explain and guide the overseas investment'activities of the principal part; so that it could provide theoretical interpretation and legal requirement for China's overseas investment.
