| 摘 要： | 家庭是人类社会的基本细胞，是国家与公民之间联系的桥梁。家庭具有维护家庭成员利益与维持社会秩序的双重功能，家庭权具有“权利”与“权力”的双重属性。个人主义理念盛行，家庭权中“权力性因素”弱化，“权利性因素”彰显，家庭在现代社会遭遇重大挑战。为发挥家庭在现代社会的重大作用，我们需要重新审视家庭权相关法律理论，并以理论为指导，重构适合社会需要的现代家庭法律制度。
