论环境生态利益的刑法保护

环境犯罪的实质是对生态利益的损害,保护环境生态利益是环境刑法的根本目的。我国现行环境刑法对于环境犯罪的立法规定没有考虑环境犯罪的特殊性,更多关注人身与财产利益,忽略对生态利益的保护,不利于促进经济与生态的协调发展。在绿色生态文明时代,环境刑法应具有明确的立法导向,注重对环境生态利益的刑法保护。文章对实现环境生态利益的刑法保护进行了分析与讨论,并对完善我国环境刑法提出了几点建议。

On the Legal Protection of Environmental Interests

Crime committed to the environment is the damage to the eco system,and it is based on protecting environmental interests that environment law is legislated.The current legislative regulations do not take the particularity of environmental crime into consideration,and focuses more on human and property protection,overlooking the protection of environmental interests.This will lead to an imbalanced development of economy and the eco system.This paper proposes a few suggestions to compliment the current legislative regulations with a focus on protecting environmental interests.
