绿色壁垒法律探析

绿色壁垒是环境保护与贸易保护的综合产物,具有保护生态环境、阻碍自由贸易的双重功能。绿色壁垒的实施对我国贸易、企业、环境均带来一定的负面效应。面对绿色壁垒,我们应完善国内环保立法体系和国际环保规范,建构我国绿色壁垒体系;积极参加国际环保组织和环保立法;充分利用国际环保规范,以保护全球生态环境,维护我国贸易合法权益。

Legality of Green Barrier

Green barrier is the integration of environment protection and trade protection,bearing double function as protecting ecological environment and hindering free trade.The implementation of green barrier brings about a series negative effects to China' s trade,enterprises and environment.Efforts should be made to improve domestic lawmaking and international regulations of environment protection to build up China' s green barrier system.Also we should actively participate in international environment protection organizations and relative lawmaking to make fully use of international e regulation both protect global ecological environment and maintain the legal rights and interests of China' s foreign trade.
