社会治理创新视角下的市场经济法治进路

社会主义市场经济本质上是法治经济。在强调以法治保障市场经济发展的同时,需考虑经济与社会如何实现协调共进的问题。市场经济法治原本就应与社会治理创新相生相伴,不应忽视社会治理创新需求而单纯追求经济成效。改革开放以来,中国市场经济发展专注于追求GDP增长,严重忽视了社会治理创新,衍生了大量社会问题,进而阻滞了经济发展。当下最为关键的是,结合社会治理创新在公平、效率、秩序等价值理念方面的新要求,审视中国市场经济法治与社会治理创新需求之间存在的差距,结合中国对市场经济法治的顶层设计,确立扩展公民自由、保障公民权利、提升公众参与能力、规范和约束公权力的市场经济法治进路。

On the Market Economy under the Rule of Law from the Angle of Social Governance Innovation

"The socialist market economy essentially is economy under the rule of law". However,when we emphasize the function of the rule of law in the development of market economy,there is still a need to consider the problem of coordinated development of economy and society. The modern market economy under the rule of law should be originally associated with social governance innovation,abandon the tradition of purely pursuing economic results and ignoring the needs of social governance innovation. Since the reform and opening-up,China''s market economy development has focused on pursuing the GDP growth,which practice neglected the social governance innovation,begetting a lot of social problems,and blocked the economic development. Now the most important thing is to improve the new requirements of social governance innovation in value concept of justice,efficiency,and order,to survey the current gap between market economy under the rule of law and the requirements of social governance innovation,then to establish the approaches of the market economy under the rule of law,such as extending civil liberty,protecting the rights of citizens,improving the ability of public participation,regulating and constraining the power.
