社会契约论新探

社会契约论的核心概念是权力的合法性：一切权力--最高权力并不例外--都具有合法性，因而必然都产生、形成和起源于社会成员的普遍同意或所谓社会契约。从此出发，社会契约论发现建立最高权力或国家只有一个途径，那就是人们一起订立所谓“明示”或“默示”的社会契约，亦即就最高权力所关涉的权利与义务等利益之交换达成的“明示”或“默示”的普遍同意：最高权力或国家起源于“明示”或“默示”的社会契约。

A New Probe on Social Contract Theory

The essence of social contract theory is the validity of right,which claims that all rights,including supreme power,are valid and that they all come from general agreement or social contract.Starting from this,social contract theory finds that there is only one way to establish supreme power or a state,that is,to make a social contract,either expressed or implied.It is a general agreement on the exchange of right and obligation relating to supreme right,thus supreme power or a state is originated from the expressed or implied social contract.
