| 摘 要： | 日益严重的环境问题对人性尊严造成的威胁和挑战需要通过确认新的人权来予以解除，环境权即是这一新型人权。环境权兼具公权和私权的伦理特征，是公权所要保护的完整性、持续性的环境公益与私权所要保护的个体性、当下性的环境私益相统一的核心。而作为具有底线伦理意义的消极权利与体现更多人本理念的积极权利相统一的环境权，其伦理特征则在最终为人类过“健康而富有成果”的生活的服务中得到彰显。

| Abstract: | the ever deteriorating environmental problem has posed a threat and challenge to human dignity,which entails new human rights to iron out those problems.Environmental right is one of the new human rights,which has ethical features of public rights and private rights.It also exemplifies characteristics of integrity and continuity advocated by public rights and individuality and instantaneity advocated by private rights.Whereas,the ethical features of the environmental right,which takes on both negative rights with the bottom ethnic meaning and positive rights concerned about the concept of people being the priority,will be manifested in the service for a healthy and fruitful lifestyle. |
