互联网时代涉外商标侵权管辖法律问题研究

司法管辖有界性与互联网无界性的矛盾，向传统涉外商标侵权管辖权的确定规则发起挑战。互联网的特殊性必然动摇属地原则的地位，而最密切联系原则的适用能够给新型经济模式下管辖权的认定提供全新思路，同时“商标共存”等复杂多变的侵权行为更应合理对待。特殊的互联网并未与现实生活相分离，仍需在国际商标管辖的一般原则基础上，结合具体案件，判断侵权行为地；也不能忽视属人管辖、专属管辖针对侵犯商标权行为的作用，力求在尊重国家主权、尊重国情的前提下，平衡各方的合法权益。

Research on the Legal Issues Concerning Jurisdiction of Foreign Trademark Infringement in the Internet Era

The contradiction between the boundary of jurisdiction and the unbounded nature of the Internet challenges the traditional rules for determining the jurisdiction of foreign trademark infringement.The particularity of the Internet will inevitably shake the position of the principle of territoriality,and the application of the principle of the closest link can provide a new way of thinking for the determination of jurisdiction under the new economic model.At the same time,"trademark coexistence" and other complex and changeable acts of infringement should be treated reasonably.The special Internet has not been separated from the real life.It is necessary to judge the place of infringement on the basis of the general principles of international trademark jurisdiction,combined with specific cases.Also we cannot ignore the role of personal jurisdiction and exclusive jurisdiction in the infringement of trademark rights.It is important that we strive to balance the legitimate rights and interests of all parties on the premise of respecting state sovereignty and national conditions.
