中国高铁“走出去”之专利战略展望

中国高铁是中国制造业的骄子，目前正在踏上“出海”之路，而专利是当今国际经济竞争的战略武器，也是中国高铁走出去难以绕开的问题。中国高铁企业应统筹谋划包括出口侵权之有效抗辩、开拓国际市场的专利对策、保持产品优势的专利构想在内的专利战略。可基于完整专利权、专利许可合同、专利权用尽等理由反驳侵权指控，为中国高铁走出去正名；短期可通过专利布局、专利联盟、国际合作等专利对策为中国高铁在海外立身；远期采取完善专利网、构建专利池、制定技术标准等举措助力中国高铁做强。

A Prospect of the Patent Strategy of Chinese High-speed Rail Export

As a great achievement of Chinese manufacturing,high-speed rail is exported to many coun-tries these years.The export necessarily faces the patent problem,which is a powerful strategic weap-on in the international economic competition.It is argued in this paper that,Chinese high-speed rail companies need to make an overall plan of patent strategies,which at least includes an effective de-fense of export infringement,measures to expand international market,and patent conception to keep advantages of the products.Specifically,Chinese companies can refute infringement charges based on the integration of patent rights,patent licensing contract and patent rights exhaustion;in the short term,Chinese high-speed rail can justify itself in foreign markets by means of patent distribution,pa-tent alliance and international cooperation,while in the long term,Chinese companies should complete patent network,construct a patent pool and formulate technical standards to facilitate the the export of Chinese high-speed rail.
