| 摘 要： | 在合同履行过程中的向第三人履行问题是债务履行的一种常见的特殊形式,《中华人民共和国合同法》第64条对此做了明确的规定,但在现实生活中仍会产生较多的歧义。本文试就债务人向第三人履行相近的债权转让、向第三人给付之契约做了比较分析,以便更好地适用向第三人履行的法律规定。

The Law of the Third Aspect On Trial |

| Abstract: | It's a common aspect to get fulfillment to the third of the debt performance during the contract's fulfillment. Contract laws of China gives out the definition about it. There are different understandings of this special form about the creditor's rights. The author tries to analyse this situation, especially the agreement of transfer about creditor's rights. |
