民法亲属编离婚制度之探讨

在保障离婚自由、反对轻率离婚 ,同时强化离婚救济 ,实现保护弱者利益的社会正义与法律公平的离婚立法指导思想之下 ,本文建议在起草民法典专家建议稿时应采取两种方法 :一是在现有规定的基础上进行修改 ,二是通过“另案”的方式 ,提出与原有规定不同方案。同时 ,在离婚后父母子女关系的规定中更强调保护子女的利益。

Excerpt of the Exploration of Divorce System in the Volume of Kinship of the Civil Code

With the guidance of divorce legislation in which the freedom of divorce is secured, reckless divorce is opposed, and divorce compensation is strengthened, in order to protect the interests of the vulnerable to realize social justice and legal fairness, in this article the author suggests two ways: make some modification to the current laws; formulate a new one. At the same time, as to the regulations on the post-divorce relations between parents and children, the protection of children's interests should be emphasized.
