关于监护制度的完善

监护制度是一项重要的民事法律制度 ,是婚姻家庭法的一项重要制度。民法典专家建议稿婚姻家庭法部分中专章对监护制度作了规定。设未成年人的监护及无民事行为能力、限制民事行为能力的成年人的监护二节。与《民法通则》中关于“监护”规定的比较 ,建议稿从监护的设置、监护人、监护人的欠格、监护监督人、监护人的职责和费用、监护权的中止与丧失、监护监督人的职责、监护的终止 ,以及对被监护的成年人的监护特点等各方面作了补充修改 ,初步形成了我国亲属监护制度的框架。

About the betterment of guardianship system

Guardianship system is an important legal system on civil affairs and an important one in marriage and family laws. Experts suggest that in the draft Civil Code there should be a special chapter stipulating guardianship in the marriage and family law, including two sections: one on guardianship with minors, and the other on that with non-civil capacity people. In comparison with the stipulation on "guardianship" in the "General Regulations of Civil Law", in the draft Civil Code, the contents on the establishment of guardianship, guardian, personality of guardian, obligations of guardian and his payment, suspension and forfeit of rights as a guardian, end of guardianship, features of guardianship on adults and so on are enriched or corrected. A framework of the guardianship by relatives is initially taking shape.
