| 摘 要： | 典当行自上世纪80年代在中国复兴以后,其行业定位、主管部门、管理规范一直处于变换之中.2005年商务部颁布新的<典当管理办法>后,部门立法的局限性更加突出.首先分析了我国典当行业的发展历程及法律制度沿革,然后对我国现行的典当法律制度--市场准入制度、市场风险和金融风险防范制度、事后监管制度等进行分析.最后针对立法层次低、专门监管机构缺失、风险意识淡薄等问题,提出了完善我国典当法律制度的构想.
