在自由贸易和WTO的大背景下,世界工业品市场的竞争愈演愈烈.为了满足消费者日益挑剔的需求,制造商们绞尽脑汁不断开发新的产品设计来吸引消费者.我们的知识产权法律体系应该对这种创新给予有效的保护,防止非法拷贝,促进公平竞争的市场秩序.在阐述我国外观设计法律保护体系不足的同时,适当介绍了外国的先进经验,希望能对我国的知识产权法律体系建设添砖加瓦.

Imitation or Innovation--The Legal Protection of Industrial Designs

Under the circumstances of free trade and WTO,the market competition of industrial designs is becoming increasingly fierce.To meet the great meed of the consumers,manufacturers try their best to develop new designs to attract consumers.The intellectual property law system should protect such designs against unauthorized copying to ensure an order of fair play.This paper has dealt with the limitation of the legal protection of designs and introduced the exprience abroad,in the hope of helping the perfection of the construction of the intellectual property law system.
