| 摘 要： | 本文尝试将社会结构和法律制度结合起来探讨中国古代社会秩序的生成机制和生成过程,重点考察了中国古代法律制度如何从礼刑分离的礼制过渡到法家的法制、最终形成礼法合一的社会基础。并且指出,中国法律制度的演变过程和中国社会结构的变迁是相互适应和相互推进的。

| Abstract: | This paper tries to discuss the mechanism and process of social order in ancient China by banding together its social structure and legal system, focusing on the social base on which the ancient Chinese legal system developed from Li institution into Fa institution and finally into the syncretism of Li and Fa. Moreover, the paper also suggests that the development of Chinese legal system has been going together with the change of Chinese social structure. |
