| 摘 要： | 目前患者隐私权不断与其他权利产生冲突,这种权利冲突的本质是利益或价值的冲突。患者隐私权难以界定的调整范围、传统医学主义的影响、法律自身的缺陷以及患者对隐私权的认识误区都是产生冲突的原因。通过立法的权利配置和司法的利益衡量可以使这种冲突得到缓解和协调。

| Abstract: | Nowadays there are constant conflicts between patients' privacy right and other rights,which are conflicts of values or profits in essence.There are four major reasons: vague boundaries of patients' privacy right,the influence of traditional medical science,deficiencies in law and misconceptions of patients.This conflict can be mitigated by rights allocation in legislation and profit assessment in jurisdiction. |
