成年监护改革的女性主义解释

我国现有的成年监护制度是在父权主义的语境下制定的,其落后的立法理念及僵化的监护措施已经无法适应日益严峻的老龄化现状。从女性主义的角度出发,将女性关怀伦理适用于成年监护改革中,摒弃传统的"理性人"标准,将监护人的监护理念由"控制管理"扭转为对被监护人的"关爱尊重",引入更加柔和灵活的"代理型"意定监护,实现成年监护制度的"女性主义化",将更能满足老年人的身心需求并有效解决老年群体的监护问题。

A Feministic Interpretation of Adult Guardianship Reform

China’s legal guardianship legislation was written in the context of the paternalism, whose legal theory and attitude towards the parties of the guardian relations are not suitable for China’s aging so-ciety. However, the combination of care ethics of feminism and the guardianship theory provides new in-spirations for the solution of issues concerning guardianship of senior citizens. Legislators should abandon the traditional standard of“reasonable man”, shift the notion of guardianship from“control and manage-ment” to “care and respect” and introduce a more flexible “agent-type” self-determined guardianship. This “feministic approach” caters to the needs of senior citizens and will solve their guardianship more ef-fectively.
