劳动权性质论

劳动权从私权利上升为基本权利，有其特定的经济背景和理论基础。作为一项基本权利，劳动权既具有生存权、发展权的属性，也有受益权、自由权的性质。作为基本权利的劳动权与劳动法上的劳动权利在性质上是不同的。劳动权也不同于劳权，劳动权具有母体性和派生性，劳权具有综合性和可分性。就业权是劳动权派生出来的一项子权利，和劳动权母体本身不能等同。大学生创业仍然是劳动权实现的一种形式。
