循环经济立法对“两型社会”建设的影响——以《循环经济促进法》为例

循环经济立法是建设资源节约型和环境友好型社会的重要方面，其所产生的影响包括三个层面：在宏观层面上，循环经济立法是落实科学发展观、建设“两型社会”的重要保障；在中观层面上，《循环经济促进法》的出台对现行立法产生了冲击，与《固体废物污染环境防治法》、《清洁生产促进法》有一定的重复和交叉，应进行相应的修改完善；在微观层面上，《循环经济促进法》对企业提出了新的要求。我国企业应抓住机遇，树立“生态理性经济人”的理念，积极采取应对措施。

Influences of circular economy legislation on the building of resource-saving and environment-friendly society

Circular economy legislation influences the building of resource-saving and environmentfriendly society at three levels. At the macroscopic level, circular economy legislation is the guarantee of implementing the scientific outlook of development and building resource-saving and environmentfriendly society. At the middle level, there are some conflicts and overlapping between Solid Waste Pollution Prevention and Control Law, Cleaner Production Promotion Law, and Circular Economy Promotion Law, and consequently some legal modifications are necessary. At the microscopic level, the law of circular economy means new demands on enterprises and corporations, who need to meet them by taking effective measures to become ＂eeo-economic man＂.
