从以人为本的视角看当代中国宪法哲学的价值取向

文章认为以人为本理应成为当代中国宪法哲学的基本内核与根本理念：第一，人本宪法哲学价值取向回应了扩展权利的时代要求；第二，人本宪法哲学价值取向顺应了公民加强人权和公民权保障的要求；第三，从历史发展进程角度看，人本宪法哲学价值取向符合立宪主义的价值观。文章还从树立权利本位、宪法和法律至上的思想，限制行政权力，建设有限政府，依法立法，改革司法等方面探讨了切实强化人本宪法学价值取向的措施。

Humanistic perspective of the value orentation of contemporary Chinese Constitution philosophy

This paper proposes that humanism be the kernel and basis of contemporary Chinese Constitution philosophy.First,the humanistic value orientation responds to the request of right expansion of the age;second,the value orientation complies with the citizens' appeal to strengthen human rights and civil rights safeguard;third,the value orientation,viewed from the angle of historical development,conforms to the value of constitutionalist principles.Last,measures are suggested to establish right standards and ideas of supreme law and Constitution,to restrict administrative authority,have limited government and legal legislation and reform judicature.
