风险管理视角下公职人员的利益冲突及其防控

利益冲突是处于公私利益交织背景中的公职人员在腐败机会刺激下所面临的两难决策情境。在风险管理视角下，这是导致腐败的危险因素。防止公职人员利益冲突是预防腐败的重要内容。诉诸伦理、立法和制度则是防止利益冲突的一般路径，由于缺乏有效的实施机制，实际效果尚不理想。廉政风险防控管理是防止利益冲突的最优解。因为廉政风险防控的机理就是预防和控制因各种危险因素聚合导致的危险事件（各种腐败行为）的发生。除了作用机理的适用性，廉政风险防控管理对于防止公职人员利益冲突还具有综合性、可操作性、针对性和科学性等优势。

Conflict of Interests of Public Officers and Its Prevention and Control from the Perspective of Risk Management

Conflict of interests is a dilemma of decision-making under the background in which the public officers,stimulated by the chances of corruption,face the mingling of public and private interests.From the perspective of risk management,the elements of the dilemma are the risk factors leading to corruption.Preventing conflicts of interests of public officers is an important part of corruption prevention.The general path of preventing conflicts of interests by resorting to ethics,legislation and the system has not achieved the ideal results because of the lack of effective enforcement mechanisms.The risk control and prevention currently arising is the optimal solution to prevent conflicts of interests and construct incorrupt governments.The mechanism of the risk control and prevention of incorrupt governments is to prevent and curb the aggregation of risk factors which may lead to the corruption.In addition to the applicability of the mechanism of action,the risk control and prevention of incorrupt governments also have advantages of integrity,operability,targetedness,and scientificness.
