| 摘 要： | 由于中国大陆现行涉外婚姻家庭法对特定的涉外身份领域的立法空白,基于现实需要,在中国大陆运用"直接适用的法",即直接适用外国法或外法域法或司法判例,解决特定涉外身份领域的民事法律冲突,符合法的目标价值、形式价值以及国际私法的相关理论。"直接适用的法"是解决特定的涉外身份领域民事法律冲突不可缺少的补充办法。

| Abstract: | The actual foreign family marriage law in Mainland China in the field of special foreign identity still remians a blank.Based on the practical needs,it is proposed that the "directly applicable law"be applied as an indispensable complement in the Mainland,i.e.foreign laws or the law beyond those in mainland China or judicial prejudication be used directly to solve the civil law conflicts involving special foreign identity.Such a practice is believed to meet the target value and form value of law,and consist with the theories related to international private law. |
