| 摘 要： | 较为常用的法律推理的涵义有三种:第一,法律推理是形式逻辑推理在法律中的应用;第二,法律推理就是法律规范推理;第三,法律推理是法律适用的推理。作者对这些定义进行评价。法律推理主要有以下特点:第一,法律推理的思维功能是论辩推理;第二,法律推理的总体思维模式属于"演绎论证模式";第三,法律推理的逻辑结构是形式逻辑推理与论辩推理的综合运用;第四,法律推理的推理功能表现为一种实践推理。

| Abstract: | Three meanings of legal reasoning are being commonly used: first, legal reasoning is the use of formal logic reasoning in law; second, legal reasoning is the reasoning of the norms of law. third, legal reasoning is the reasoning of the applicability of law. Based on the author's review of the meanings, the features of legal reasoning are analyzed as follows: First, the thinking function of legal reasoning is argumentative; second, the thinking mode of legal reasoning on the whole is deductive; third, the logic structure of legal reasoning is a combination of formal logic reasoning and argumentative reasoning, and fourth, the reasoning function of legal reasoning represents itself as practice-oriented reasoning. |
