| 摘 要： | 我国现行的农村土地承包经营制度在管理上存在土地产权界定不明确、土地承包经营权保护不力、流转受到限制等问题,不利于土地资源的开发和利用。同时,在农村土地承包经营制度的相关立法上也存在问题。文章从物权法的视角提出完善举措:明确土地承包经营权的性质,保障权利主体权能的实现,加强相关立法,以更好地开发和利用土地资源。

| Abstract: | There exist unclear definition of land property,inadequate protection of the right for and restriction to the transfer of contracted land as far as the current rural land contract and operation system is concerned.These problems are harmful to the development and use of land resources. There are also problems in the relevant legislation regarding the current rural land contract and operation system.The paper studies the measures for improvement including defining the nature of contracted land resources,protection of the right for contracted land resources,strengthening the legislation concerned,and the best use of land resources. |
