| 摘 要： | 行政法是行政实体法和行政程序法的有机统一.法律上的权利义务,既有实体的,也有程序的.违反程序义务同样应该承担法律责任.行政程序的基本要素中,步骤和方式,构成行政程序的空间表现形式;顺序和时限,构成行政程序的时间表现形式.行政程序法应体现、贯彻一定的原则,并适用相应的制度.

| Abstract: | The administrative law is a unity of the administrative substantive law and the administrative procedure law. Legal rights and obligations are covered in the above two aspects. If someone violates the procedural obligation, he should take the legal responsibility. In the basic components of an administrative procedure, step and manner are its spatial representation, and order and period are its temporal representation. The administrative procedure should represent some principles and serve some systems. |
