浅析鉴定人制度

经过理论与立法实践的发展,我国司法鉴定制度的改革和完善已经取得了重大的进展,但是在有些问题上仍然存在争议,由于鉴定人在整个司法鉴定过程中起着举足轻重的作用,是鉴定活动的实际承担者,鉴定人的法律定位、资格认定和选任、鉴定人的权利义务以及法律责任等内容,是构建合理的司法鉴定制度使之与现代诉讼活动的发展相适应不得不考虑的问题。

Discussion of the Expert Witness System

With the development of theory and the legislation practice,because the expert witness played an important role in the entire expert evidence process,and is the actual actor which appraised the activity,the expert witness system reform and the consummation of our country has already made the significant progress,but there are still some problems.Thus,we have to consider the legal position of the expert witness,the qualifications,the rights and duties as well as legal liabilities,in order to construct the reasonable expert evidence system and make it adapt with the modern lawsuit activity development.
