| 摘 要： | 商主体具有不同于民事主体的若干法律特征,民商分立制多将其在商法典中予以规定,并在商法通则(总则)中系统规定商主体的概念、特点、种类等。我国采用民商合一制,虽不拟制定商法典,但有必要建立完备的商主体制度,这必将有益于商主体立法。

| Abstract: | The main body of commerce has several characteristics which differ from that of civil affairs.The separated establishment system of ci vil commerce is largely determined in the commercial code.Meanwhile,the notions, peculiarities and categories of the main body are systematically determined in t he general principles of the commercial law.In our country a joint system of civ il and commercial affairs is adopted.Though the code of commerce is not to be ma de,it is necessary to build a perfect system of the main body of commerce which will benefit the legislation of it. |
