四川旅游环境行政执法法律制度研究

旅游环境行政执法指旅游行政执法主体在法定的行政管理领域内,适用旅游法律、法规、规章、规范性文件进行环境(包括自然环境和社会环境)监督管理的活动。我省旅游环境行政执法的主体相当多,分为四类,执法的依据的范围也十分广泛,这是由旅游环境法调整对象的广泛性、综合性决定的。社会监督是四川旅游环境依法行政执法的保障。旅游环境行政执法主体在内的行政执法主体按照法定程序执法是对环境行政执法主体行使执法权的一种必要节制,是法律规定的职责,是依法行政的一个重要方面。

The Study on the Law System of Tourist Environment Administrative Enforcement of in Sichuan

The administrative law enforcement of tourist environment means that the subject of tourist administrative law enforcement supervises the management of environment(includes natural environment and social environment) through applying the law and the regulation on travel to the legal administrative field.Quite a lot of subjects of the tourist environment administrative law enforcement of our province are divided into four kinds and the range of bases of enforcing the law is very extensive too,which is decided by the comprehensiveness of the object regulated by the tourist environment law.The social supervision is the guarantee of the administrative law enforcement abiding by laws of tourist environment of Sichuan.It is a necessary limitation to the power of the administrative subject including tourist environment enforcing the law according to due procedure of law,a duty of the legal provisions and an important respect of administering the state according to law.
