| 摘 要： | 《大明律》的制作修订 ,与以前的律书一样 ,充分体现了依礼制法、以礼入法、以法护礼、以法行礼的原则精神。首先 ,“明礼以导民 ,定律以绳顽”,是明洪武君臣制定《大明律》的宗旨。其次 ,《大明律》“重礼”,亦足以证明古代刑法依据礼制并维护礼制。再次 ,《大明律》及其炮制者与古代律书、礼书有很深的关系。

| Abstract: | Like many other former books about statutes,the formulation and revision of Statutes of Da Ming fully embodies the principles of laying down laws according to etiquette, of making etiquette conforming to laws, of using laws in defending etiquette and of practicing etiquette according to laws. Firstly, the aim of Statutes of Da Ming made by Emperor Hongwu and his Subjects of the Ming Dynasty is "to make etiquette clear to guide people and enact decrees to punish evil doers". Secondly, the emphasis on etiquette of Statutes of Da Mingalso give a proof of the defense of etiquette on the basis of ancient criminal law. Thirdly,Statutes of Da Ming and its concocters are closely connected with ancient legal books and records of etiquette. |
