| 摘 要： | 循环经济这种新的经济增长方式将对保护环境起到重要的作用,但循环经济不等于环境保护,循环经济法不是环境法。将循环经济法视为环境法将会导致其与现有环境法体系的冲突。从立法层面看,应在环境法领域贯彻循环经济理念,并加强循环经济立法前期的准备工作,而不是急于进行循环经济专项立法。

| Abstract: | As a new mode of economic growth,circular economy will also be an important method to protect environment.But circular economic law is not an environmental law.Circular economic law misunderstood as an environmental law will conflict with the whole environmental law system.What should be done now is to carry out the circular economic policy in environmental law system,and prepare for the legislation on circular economy.It is not a proper time for the legislation on circular economy in this period. |
