| 摘 要： | 我国驰名商标法律制度基本建立,但仍存在一些缺陷,如驰名商标的法律性、时间性不明确;驰名商标的使用规则和要求不明确;驰名商标能否转让或被许可不明确;对未注册驰名商标的保护力度不够;等等。这些不足之处,不仅引起理论上的争议,更引起实践中的混乱。针对存在的问题,提出进一步完善我国驰名商标制度的立法建议。

| Abstract: | China's famous trademark system has been basically established, but it still has some flaws, such as the ambiguity in the legal nature and valid period of famous trademarks, the ambiguity in the rules and requirements for the use of famous trademarks, the ambiguity in the transfer and licensing of famous trademarks, the inadequate protection for unregistered famous trademarks, etc. These flaws not only cause the dispute in theory, but also result in the chaos in practice. In view of the existing problems, this essay proposes the legislation suggestion to further improve China's famous trademark system. |
