浅论新型农村合作医疗医患法律关系

在新型农村合作医疗制度中,医患双方权利义务内容的配置和利益冲突的协调,关系到参合农民的医疗保障水平和医药费用的控制。新型农村合作医疗制度的政策法规与试点实践表明,新型农村合作医疗制度属非典型社会保险性质,这一定性决定了参合农民与定点医疗机构之间权利、义务内容的具体配置以及法律责任的承担方式,也决定了新型农村合作医疗医患双方纠纷解决机制的选择与基本构建。文章结合新型农村合作医疗试点中出现的问题,对参合农民享有的自益权与共益权,定点医疗机构的法律责任和医患双方合法权益的救济途径等提出了相应的立法建议。

The Related Law Problem Study of the Relationship between Medical Organizations and Patients of the New Rural Cooperative System

Disposing the right and duty and coordinating the benefits conflict between medical organizations and patients of the new rural cooperative system play a very important part in the control of medical treatment guarantee level of the farmer and that of the medicine expenses.Based on the laws,policies and practice,the new rural cooperative system belongs to the social insurance property of non-typical model.This defination of its nature decides the match of the contents of right and duty and the way of bearing responsibility between medical organizations and the farmers,and the choice and design of mechanism of disputes settlement as well.This text,combining the problem arising in the pilot project,put forward the homologous lawmaking suggestion about the right of farmers,the law responsibility of the medical treatment organizations and the succour path of the two parties.
