精神损害赔偿的惩罚功能之反思

民法学界有关精神损害赔偿功能的争论由来已久，目前认为精神损害赔偿具有填补、抚慰和惩罚“三重功能”的学说渐趋主流。从理论上分析，精神损害赔偿的惩罚功能只能是对填补和抚慰功能的一种补充，而不宜视作精神损害赔偿的主要功能。精神损害赔偿的惩罚功能与惩罚性赔偿分属不同的制度领域，未来应当将二者明确区分开来，从而更好地发挥精神损害赔偿的填补和抚慰功能。

Reflections on the Function of Punishment of Mental Compensation

There has been a long-standing debate about the function of mental compensation in civil law.At present,it is believed that the theory of “three functions”of mental compensation,which is compensation,conciliation and punishment is becoming mainstream.Theoretical analysis shows that the penalty function of mental compensation can only be a supplement to the function of compensation and conciliation,but it is not as the main function of mental compensation.The function of punishment of mental compensation and punitive compensation belong to different fields,so we should make a clear distinction between the two,so as to exert the function of compensation and conciliation of mental compensation.
