从私人性到公共性——论公共权力的属性和归宿

本文试图从权力的两重属性(即私人性和公共性)来梳理权力的内在运行法则.本文认为权力的私人本能性是促使权力不断占有社会资源的动力,而社会资源的稀缺就会造成资源占有者对缺乏者的支配.这种支配性权力就是控制权.与支配性权力相对的是个人自主性的行动权.正是行动权(包括人的行动和言语)赋予了个人自我展现的能力.按照私人性逻辑生成的公共权力将会对社会道德责任造成严重的压力,所以本文提出应该以公共性为价值目标用行动权、制度公共性等概念来重新解释和构建公共权力.

From Individuality to Publicity:The Nature and Course of Public Power

From the two attributes of power-individuality and publicity,this article tries to analyse the inner principles of its circulation.This article confirms:the private instinct of power is the impetus to make it capture as many social resources as possible,and the scarcity of the latter leads to the dominance of those who lack it.This dominative power is called "power over",which reverses to the autonomous power-"power to"which enables people to exhibit themselves.Because of the individuality logic of the public power,it causes great pressure to the social ethics.Based on these grounds,this article deems that the public power should be guided by the value of publicity,illustrated or reconstructed through the notions of action rights,institution publicity etc.
