| 摘 要： | 刑法的刑事政策化已经成为当今我国刑法学发展的大趋势,它实际上是对近代以来西方国家刑事政策发展演变过程的概括总结。我国刑事立法整体上已经体现了这一思想,但是,在具体的刑法适用方面还存在很多问题。因此,就借鉴和发展“刑法的刑事政策化”思想而言,当务之急是总结和分析现代刑事政策学的研究成果,将其融会贯通到我们的刑法适用中来。

| Abstract: | It has been a great tendency for criminal law to change to a criminal policy. Actually, the tendency is a summary of the development of the criminal policy which has been occurring in western countries recent years. Our criminal legislation has already reflected the theory. Nowadays, We should sum up and analyze the achievement of the criminal policy science, and use them in our application of criminal law. |
