| 摘 要： | 民营企业是与国有国营企业相对应的一种企业类型,是民间主体经营除国家投资和国家专营企业以外的企业形式。民营企业走向法治化既是我国社会主义市场经济的需要,也是社会主义法制的要求。目前是否需要对民营企业的权利和义务以及法律保护等进行专门的立法,学界有不同看法。从我国民营企业的法律性质和地位、财产权与经营权的关系、管理制度及内部机制的现状看,民营企业的法律保护应立足于现有法律法规的修正、补充、整合和协调完善。

| Abstract: | Private enterprise is a kind of corporation type related to the state enterprise,which is the corporation type,managed by personal partners except state investment and state management companies.Presently,the distinct perspectives exist in law system related to whether the technical legislation made according to legal protection for the rights and obligations of the private enterprises of China.According to the actuality about the law character and status of private enterprises in our Country,the relationship between the property rights and management rights,administrative system,the law protection for private enterprises should stand on the modification and complementarities of existing code. |
