涉外民事关系法律适用法中结婚法律适用条款研究

《中华人民共和国涉外民事关系法律适用法》确立了涉外结婚法律适用的基本规则,通过属人法和婚姻缔结地法的结合适用,对结婚实质要件和形式要件的法律适用分别做出了规定。但在实质要件的法律适用方面对婚姻缔结地法的适用施加了不适当的限制,在形式要件的法律适用方面"手续"一词的使用不够严谨,代之以"形式"一词更为妥帖,而且规则表达方法与冲突规范的一般表达方法不符。因此,未来立法修改可以考虑取消对婚姻缔结地法适用上的限制,并在具体规定上采用国际通行的概念或术语,采用冲突规范的惯常表达方法,从而使中国关于涉外结婚的冲突规范更趋完善。

Research on Foreign Marriage Law Applicable Provisions

＂The Law of the People＇s Republic of China on Application of Laws to Foreign-Related Civil Relation＂ establishes the basic rules applied to foreign marriage and in conjunction with the conclusion by the law of personal law and marriage. The law applies to substantive elements of marriage and the formal requirements of the regulations were made. But in terms of the substance, the conclusion of the marriage is imposed undue restrictions. In terms of form, the ＂procedure＂ is used loosely, it is more appropriate to be replaced by the word ＂form＂ and the methods of expression don＇t match the conflict of rules. Therefore, future legislation can consider lifting restrictions on the conclusion of the marriage, and use internationally accepted concepts or terminology specific provisions on the conflict of rules so that our conflict on foreign marriage norms becomes more perfect.
