中国政策冲突的降解之道——建构兼容性政策网络

政策由政府和其他公权力机构制定并执行,以维护公共利益、实现公共目标和发展公共事业,特定的政策经过合法程序可转变成法律。缘于环境不和谐、法律体系有冲突、目标不一致、信息难共享、彼此不信任、政策不清理等引发的政策冲突导致公共利益受损,公共政策目标渐行渐远,甚至阻滞法治环境的进步。兼容性政策网络建构多元参与者的协商对话平台,打破科层制对行政体系和公共政策的束缚,促成单项政策与其他不同层级、不同类别政策的信息共享和信任联动,形成各级政府、社团乃至个人之间的无障碍沟通渠道,降解政策冲突和整合国家整体力量,实现地方自主治理、各级政府协调一致、服务公共目标、推进公共事业发展和完善法治环境。

The Approach to Reduce China＇s Policy Conflicts： the Construction of Compatible Policy Network

Policies are formulated and executed by governments and other public authorities to protect public benefits,achieve public aims and develop public utilities.Following legal procedures,specific policies can also change into laws.Because of environmental problems,legal conflicts,different aims,exclusive information,mistrust,and failures in policy clearance,etc.,a number of policy conflicts have been raised,which severely jeopardizes public interests,hinders the realization of its aims,and even blocks the progress of Legal environment.In contrast,compatible policy network can construct the platform of consultation among multi-participants,break down the shackles of bureaucracy on the administrative system and public policy,and creates a barrier-free communication platform for governments of different levels,communities and even individuals by enhancing their information sharing and mutual trust.In this way,local self-governance and coherence among governments of different levels can be achieved by means of resolving policy conflicts and integrating the country’s overall strength for public service,which will eventually promote the development of public utilities and improve the legal environment.
