见危不救犯罪化初探

见危不救属于传统道德调整的范畴 ,在道德资源缺乏的今天 ,见危不救的事件频频发生 ,道德对这个领域的调整已经力不从心。将危难救助作为法定义务加以规定 ,并在刑法中相应地增设“见危不救罪”是无奈却理性的选择 ,但是应该将法律干预保持在维持社会生存基本需要的范围内 ,避免对救助人或第三人的合法权益造成损害 ,并建立相应的救助人伤害或损失的社会保障机制

On the crime of the non- salvation - in - danger

Non-salvation-in-danger seems to be adjusted by traditional morals.Today,morality resources become less and less,non-salvation-in-danger repeatedly occurs.The morality should regulate this field,but it far exceeds its ability.The authors think that is no opt but to provide slavation-in-danger as a legal obligation,and accordingly add a charge of non-salvation-in-danger to criminal law,after all it's a rational choice.The authors suggest that the legal intervention should keep within the limits of the basic need of social subsistence,avoid injuring lawful rights and interests of the savior as well as the third person,and establish a correspondig mechanism of social safeguard so as to make up the savior's damage or loss.
