调解的法治与德治

从法治的角度看 ,由于调解不仅依据法定的授权进行 ,而且按照法律的规定　　袁翔珠　　　 　开展工作 ,因而它完全符合法治的精神 ;从德治的角度看 ,调解充分体现了道德的感召作用　调　解　的　法　治　与　德　治和劝导作用 ,所以调解是法治与德治的经典结合。法治与德治相辅相成、相互促进 ,是一个紧密结合的整体 ,正确适用调解、充分发挥调解的作用就要找准“法”与“德”的结合点

Rule by Law and Rule by Morale in Mediation

The mediation in our country and it's three ty pe s are discussed in this thesis. From the rule by law,because the mediation not o nly is underway by empower ment of the law,but also developes by stipulations of the law,it fully tallies with the spirit of the rule by law;From the rule by mo rale,the mediation amply embodies the action of the influence and advise of the morale,so mediation is the classical combination of the rule by law with the rul e by morale.The rule by law and the rule by morale are supplementary to each oth er and promotive of each other,they are an integrated system.It is important to find the combination point,so to use accurately the mediation and bring the func tion of the mediation into full play.
